AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "user"), and QuoteMyHomeowners.com ("Company," "we," "us," "our"), concerning your access to and use of the QuoteMyHomeowners.com website, as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

By using the Site, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Site is a lead generation service that connects homeowners seeking insurance quotes with licensed third-party insurance agents and carriers ("Insurance Partners"). We are an independent service provider and do not hold a license as an insurance agent, carrier, or broker. We do not endorse, recommend, or guarantee the services of any Insurance Partner. All insurance quotes, policies, and related services are provided solely by third parties, and any agreement you enter into is strictly between you and the Insurance Partner.

2. USER REPRESENTATIONS AND RESPONSIBILITIES

By using the Site, you represent and warrant that:

• a) You are the legal owner of the property for which you are seeking a quote or are authorized to act on the owner's behalf.
• b) All registration information you submit will be true, accurate, current, and complete.
• c) You will not use the Site for any illegal or unauthorized purpose.
• d) Your use of the Site will not violate any applicable law or regulation.

3. THE QUOTE PROCESS AND YOUR CONSENT TO BE CONTACTED

By submitting a request for a quote on the Site:

• a) You are inquiring and expressly requesting to be contacted by Insurance Partners via telephone, SMS, email, or other means, even if your phone number is on a corporate, state, or national Do Not Call registry.
• b) You understand that you may receive telemarketing calls or messages from multiple Insurance Partners using automated technology.
• c) You acknowledge that we may share the information you provide with multiple Insurance Partners to facilitate your quote request.
• d) You are under no obligation to purchase any insurance policy from any Insurance Partner.

4. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics, and the trademarks, service marks, and logos contained therein (the "Content") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States.

5. DISCLAIMER OF WARRANTIES & NO GUARANTEES

• THE COMPETITIVENESS OF ANY QUOTES OFFERED.
• THE SUITABILITY, QUALITY, OR TERMS OF ANY INSURANCE POLICY.
• THE ACCURACY OF INFORMATION PROVIDED BY INSURANCE PARTNERS.

6. LIMITATION OF LIABILITY

IN NO EVENT SHALL QUOTEMYHOMEOWNERS.COM, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR DATA LOSS, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR MAXIMUM LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICE.
